Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Momento mobile application, website, and related services (collectively, the “Service”). The Service is owned and operated by Humora Technologies Private Limited(“Momento”, “we”, “us”, or “our”), a company incorporated in India. By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years of age (or the minimum age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date. Notify us immediately of any unauthorised use of your account.

3. User Content

Momento lets you upload, share, and organise photos and other content (“User Content”). You retain ownership of your User Content. By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, process, display, and distribute that content solely for the purpose of operating and improving the Service (including generating thumbnails and performing AI-based face grouping to help guests find their photos).

You represent that you have the necessary rights and consents to upload your User Content and that it does not infringe any third party’s rights or violate any law.

4. Acceptable Use

You agree not to use the Service to:

  • upload content that is unlawful, infringing, obscene, or harmful;
  • harass, abuse, impersonate, or harm other users;
  • upload images of individuals without their knowledge where required by law;
  • attempt to gain unauthorised access to the Service or its systems;
  • interfere with or disrupt the integrity or performance of the Service.

We may remove content or suspend accounts that violate these Terms or applicable law.

5. Face Recognition

The Service uses face-grouping technology to help event guests discover photos they appear in. This processing is described in our Privacy Policy. You may request deletion of your facial data at any time by contacting us.

6. Payments and Subscriptions

Certain features are offered on a paid basis. Fees, billing cycles, and storage limits are disclosed at the point of purchase. Payments are processed by third-party payment providers. Except where required by law, fees are non-refundable.

7. Notifications

Momento may send you notifications related to event and app activity, including photo matches and event updates. You can manage your notification preferences in the app settings.

8. Intellectual Property

The Service, including its software, design, and trademarks, is owned by Humora Technologies Private Limited and is protected by applicable intellectual property laws. These Terms do not grant you any right to use our branding without our prior written consent.

9. Termination

You may stop using the Service at any time and may delete your account. We may suspend or terminate your access if you breach these Terms or if required to do so by law. Upon termination, the licences you granted to us will end, except to the extent content has been shared with others or must be retained to comply with legal obligations.

10. Disclaimers

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, to the maximum extent permitted by law.

11. Limitation of Liability

To the maximum extent permitted by law, Humora Technologies Private Limited will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of the Service.

12. Governing Law

These Terms are governed by the laws of India. Subject to applicable law, the courts at Maharashtra, India shall have exclusive jurisdiction over any disputes arising from these Terms or the Service.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified through the Service or by other reasonable means. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
